§ 31.04. E-911 SERVICE CHARGE; E-911 SERVICE FEE.

  • (A) In accordance with the terms of the agreements authorized in § 31.02 and in order to fund the establishment and the operation of E-911 service in the county, all local telephone exchange subscribers within the county shall be billed a monthly E-911 service charge of $2.25 on an individual telephone exchange line basis, limited to a maximum of 25 exchange lines per account.
    (B) The monthly E-911 service charge shall begin on the date E-911 service is in operation, and all revenues collected from the service charge shall be expended solely for the purpose of funding E-911 emergency services in the county.
    (C) In accordance with the terms of the agreements authorized in § 31.02, the telephone companies entering into an authorized agreement shall bill and collect the monthly E-911 service charge and shall remit the revenues to the Fiscal Court.
    (D) A new E- 911 service fee shall be established initially at $4.75 per month for each retail water customer that receives active billing for water service located in the county.
    (1) The service fee shall automatically increase or decrease in accordance with changes in the Consumer Price Index, all urban consumers, all items, unadjusted (1967=1.00) as published by U.S. Department of Labor, Bureau of Labor Statistics, hereinafter referred to as “CPI”, annually beginning January 2019 on a calendar-year basis.
    (a) As promptly practicable after January 1, 2020, and each January thereafter, the county shall compute the change, if any, in the cost of living for the preceding one-year period, based on the CPI.
    (b) The CPI number for January 2019, and each January thereafter, shall be the “base index number”, and the corresponding CPI number for December 2019 and each December thereafter shall be the “current index number” for the first CPI adjustment period, rounded to the nearest nickel.
    (c) The current index number shall be divided by the base index number. From the quotient thereof, there shall be subtracted the integer 1, and any resulting positive or negative number shall be deemed to be the percentage of increase or decrease in the CPI.
    (d) The percentage of increase or decrease multiplied by the then current monthly fee rate shall be the change required in the newly determined fee.
    (e) Within a reasonable time after obtaining the appropriate data necessary for computing such increase or decrease, the county shall notify the appropriate parties of the CPI change in the fee.
    (f) The CPI adjusted monthly fee to fund E-911 service shall become effective and be billed as of April 1 through March 31 for each 12-month year.
    (2) Along with applicable taxes, this E-911 service fee shall be collected by each water company, district, association and provider of a water distribution system in the county for each retail water customer that receives active billing for water service in the county in advance of the month or any part of the month for which service is provided. The fee will not be prorated for service less than a full month.
    (3) Each water company, district, association and provider of a water distribution system in the county shall remit on a monthly basis such fees collected to the county E-911 service, and shall be permitted to withhold 2% of these monies for the administration of this fee.
    (4) The E-911 service fees collected pursuant to this division are not a portion of the rate charged for water distribution, but are a fee levied on the customer for the exclusive purpose of funding the delivery of E-911 emergency telephone service in the county as provided for by KRS 65.760.
    (5) Water service cannot be discontinued for the nonpayment of the E-911 service fee. For those customers not paying the E-911 service fee, the county can pursue all legal remedies for nonpayment and noncompliance with this division.
